Article 1: Definitions
In these Terms and Conditions:
- Patient: a patient and/or their legal representative who receives online treatment and/or consultations from the Clinic.
- Clinic: The Migraine Clinic Ltd (TMC), a company registered in England and Wales under company number 17343112, with its registered office at 65 London Wall, London EC2M 5TU. The Clinic provides its care fully online.
- Treatment agreement: any agreement between a patient and a care provider of the Clinic, or the Clinic itself, under which the care provider or the Clinic undertakes to perform acts directly relating to the care of the patient.
- Medical acts: an online consultation or treatment, any examinations, and all other care or services, whether or not medical specialist care, provided by or on behalf of the Clinic.
- Service agreement: the agreement under which the Clinic, in addition to a treatment agreement and/or a standalone agreement, undertakes to provide (or have provided) services to the patient, to be agreed in mutual consultation.
Article 2: Applicability
These Terms and Conditions take effect on 24 September 2026 and apply to all treatment or service agreements concluded thereafter between the Clinic and the patient. Other general terms and conditions of the Clinic may apply in addition to these terms. Deviations are valid only if the Clinic expressly agrees to them in writing.
The Clinic does not provide emergency care. In an emergency, call 999 or go to your nearest A&E.
Article 3: Identification and Protection of Personal Data
Patients must be able to identify themselves with valid proof of identity on request. Refusal may result in suspension of the treatment agreement. How personal data is handled is described in the privacy statement on the Clinic's website.
Article 4: Entering into the Treatment Agreement
The agreement is formed when the patient instructs the Clinic to perform medical acts. Patients consent to the Clinic's care providers accessing their medical record. Patients have the right to access their record; the Clinic may charge a reasonable fee for copies. Confidentiality applies to the information in the record, unless legal obligations require otherwise.
The patient:
- is 18 years or older;
- holds one account, in their own name;
- answers all questions truthfully and completely, and reports changes in their health or medication;
- accepts the decision of the Clinic's clinician when treatment or medication is not considered appropriate;
- agrees that the Clinic informs their GP about the treatment, or informs the GP themselves if they prefer.
Article 5: Cancelling Appointments
Appointments must be cancelled at least 24 hours in advance, barring force majeure.
Article 6: Suspension and Termination of Treatment
The treatment agreement may be suspended or terminated if payment obligations are not met. Both parties may end it by mutual agreement. The Clinic may terminate it unilaterally for serious reasons, including improper conduct or aggression that makes the situation unworkable or damages the relationship of trust.
Article 7: Payment
Treatment is paid in advance, according to the published fees. The payment is reserved when the patient books and only taken once a Clinic clinician has accepted the patient for treatment. If the patient is not accepted, the reservation is released or the payment is refunded in full.
Because the treatment is personal, the patient agrees that it starts as soon as the clinician begins the assessment. From that moment, the patient waives the 14-day cancellation period for that part of the service.
Article 8: Medication
When medication is part of the treatment, the Clinic facilitates its payment. The Clinic does not supply medication itself: the prescription, packaging and delivery are outsourced to a pharmacy of the Clinic's choosing.
Delivery, returns and damaged or incorrect medication are handled by that pharmacy, under its own terms.
Article 9: Fees
The Clinic may change its fees without notice and always charges the fees in force. When changing fees, the Clinic takes into account UK law and other relevant regulations.
Article 10: Set-off
The patient cannot invoke set-off when the Clinic disputes the counterclaim on reasonable grounds.
Article 11: Liability
Nothing in these terms limits the Clinic's liability for death or personal injury caused by negligence, or for fraud, or any other liability that cannot be excluded by law. The patient's statutory rights are not affected.
Patients can submit a liability claim for careless medical treatment in writing to the management; the insurer investigates it and patients must cooperate.
Article 12: Code of Conduct
TMC values a safe, respectful and professional environment. Unwanted behaviour, including verbal aggression, insults, intimidation and crossing boundaries, is not tolerated. Violations lead to appropriate measures by TMC.
Article 13: Complaints
If you are not satisfied with our care or service, please tell us. You can make a complaint by email to info@migraine.org, by phone, or by post to The Migraine Clinic Ltd, 65 London Wall, London EC2M 5TU.
We handle every complaint as follows:
- we treat you and your complaint with respect;
- we keep your complaint confidential;
- we first check that the complaint concerns care or a service the Clinic provided, or a decision the Clinic made;
- we keep you informed by email or phone at each step, until the complaint is resolved.
How long an investigation takes depends on the nature of the complaint. The full procedure is in our complaints policy.
Article 14: UK Law
UK law applies to all agreements between the Clinic and patients.
Article 15: Changes to the Terms and Conditions
The Clinic may change these terms. Changes also apply to existing agreements, unless stated otherwise. Patients who do not accept changes may terminate in writing before the date they take effect.
